These Terms of Service ("Terms") are a legal agreement between you and KeepMeWise ("KeepMeWise", "we", "us", or "our") governing your use of the KeepMeWise application and website at keepmewise.com (the "Service"). Please read them carefully.
1. Acceptance of these Terms
By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use KeepMeWise.
2. Eligibility
You must be at least 16 years old (or the minimum age in your country to form a binding contract, and at least 13 where permitted with appropriate consent) to use the Service. By using KeepMeWise you represent that you meet these requirements and that the information you provide is accurate.
3. Your account
- You are responsible for safeguarding your login credentials and for all activity that occurs under your account.
- You agree to provide accurate information and to keep it up to date.
- Notify us promptly at [email protected] if you suspect unauthorized use of your account.
- You are responsible for maintaining your own copies of important data; export tools are provided for this purpose.
4. Acceptable use
When using KeepMeWise you agree not to:
- Break the law or infringe the rights of others.
- Attempt to disrupt, overload, reverse-engineer, scrape, or gain unauthorized access to the Service.
- Upload malware or content that is unlawful, harmful, or violates another person's privacy.
- Resell, sublicense, or misrepresent the Service.
- Use the Service to provide regulated medical, financial, or legal advice to third parties.
5. Subscriptions, billing, and refunds
KeepMeWise offers a free tier, a 7-day free trial of paid features, recurring paid subscriptions, and may offer one-time purchase options.
- Billing. Paid subscriptions are billed in advance through a third-party payment processor and renew automatically at the end of each billing period until cancelled.
- Cancellation. You may cancel at any time. Cancellation stops future renewals; you keep paid access through the end of the period you have already paid for.
- Refunds. Except where required by law, payments are generally non-refundable. If you believe you were charged in error, contact us and we will review your request in good faith.
- Price changes. We may change prices; changes apply to future billing periods and we will give reasonable notice.
- Taxes. Prices may exclude applicable taxes, which may be added at checkout.
6. Intellectual property
The Service, including its software, design, branding, and the name KeepMeWise, is owned by us and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal use in accordance with these Terms. These Terms do not grant you any rights in our trademarks or branding.
7. Your content
You retain full ownership of the content you create in KeepMeWise, your health data, finances, journal entries, tasks, and everything else. We claim no ownership over it. You grant us only the limited license needed to host, process, back up, sync, and display your content back to you so that we can operate the Service. You are responsible for the content you submit and for ensuring you have the right to submit it.
8. Disclaimers, not professional advice
KeepMeWise is a personal organization and tracking tool. It is not a substitute for professional advice.
- Not medical advice. Health, vitals, cycle, hormone, medication, and related features are for your own tracking only and are not medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional. Never disregard or delay professional medical advice because of something in the Service.
- Not financial advice. Budgets, goals, accounts, and transactions are tracking tools only and are not financial, investment, tax, or accounting advice. Consult a qualified professional before making financial decisions.
- AI features. AI-generated suggestions may be inaccurate or incomplete and are provided for convenience only. Verify anything important before relying on it.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or uninterrupted or error-free operation, to the fullest extent permitted by law.
9. Limitation of liability
To the fullest extent permitted by law, KeepMeWise and its providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Service. To the extent liability cannot be excluded, our total liability for any claim is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends; sections that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) will continue to apply. You may export your data before deleting your account.
11. Governing law
These Terms are governed by the laws of [Jurisdiction, to be set], without regard to its conflict-of-laws rules, and any disputes will be subject to the courts of [Jurisdiction, to be set], except where applicable law gives you the right to bring a claim elsewhere.
